Commission Design Policy

1. How to Request a Commission
All commission inquiries must be made via:

Once your project has been discussed and availability confirmed, you will receive a Commission Agreement outlining the scope, timeline, and terms. Work will begin once the agreement is signed and the deposit is received.

2. Deposit & Payment Terms
A 50% non-refundable deposit is required before any design or production work begins.

The remaining 50% is due upon final approval of the design, prior to delivery of the final files or physical product (if applicable).

No work will commence until the deposit has cleared.

All payments must be made in AUD unless otherwise agreed in writing.

3. Design Process
Once the deposit is received:
The concept and design phase begins.

You will receive progress updates and draft rounds for review.

Feedback is welcomed during the drafting stage.

Once the final design is approved, no further changes can be made.

Any additional revisions requested after approval or during production may incur extra fees.

4. Scope Changes & Additional Work
Any work, revisions, or design development outside the originally agreed scope will incur additional fees. Scope changes must be approved in writing before additional work begins.

This includes additional CAD work, redesigns, added elements, or any modifications requested after the initial agreement.

5. Client Communication & Response Time
Timely communication is essential for maintaining your project timeline. Delays caused by late client responses, missed messages, or slow approval of drafts will extend the turnaround time.

Pleiosien is not responsible for missed deadlines resulting from delayed feedback or approvals.

6. Material Pricing & Market Variations
Pricing for materials, gemstones, and precious metals may vary due to market fluctuations. Quotes are valid for 7 days unless otherwise stated. If material costs increase after this period, the updated pricing will be reflected in your final invoice.

7. Structural Integrity, Safety & Design Adjustments
Pleiosien reserves the right to adjust design elements for structural integrity, wearability, and safety.

These adjustments ensure the piece can be manufactured correctly and worn safely. Such modifications do not constitute a design change and are required for proper production.

8. CAD Files, Technical Drawings & Digital Asset Protection
CAD files, STL files, technical drawings, and production-ready digital assets are not included in the commission and will not be released to the client unless a separate licensing agreement is purchased.

These files contain proprietary design and engineering information and remain the intellectual property of Pleiosien.

9. Handmade Variations & Production Tolerances
All Pleiosien pieces are crafted with careful hand-finishing and professional attention to detail. Due to the nature of certain materials, such as resin, metals, and hand‑polished surfaces, subtle variations or minor imperfections may occur. These characteristics are normal and reflect the individuality of handcrafted work rather than defects.

Material behaviour may include:
- Slight surface variations
- Minor textural differences
- Natural inconsistencies in clarity or gloss
- Small marks inherent to hand‑polishing or curing processes
- Colour variation due to pigment dispersion, resin curing, or handmade application

These features do not affect the integrity or wearability of the piece and should be considered part of its uniqueness.

Clients are expected to handle all pieces with appropriate care. Avoid sharp impacts, excessive pressure, exposure to chemicals (including alcohol, perfume, or harsh cleaners), and prolonged heat or direct sunlight. Gentle handling will ensure longevity and preserve the finish of your commissioned piece.


10. Right to Decline a Commission
Pleiosien reserves the right to decline any commission request at our discretion. This includes projects that are not aligned with our design style, are structurally unsafe, ethically questionable, or involve unrealistic expectations.


11. Privacy & Confidentiality of Design Materials
All communication, sketches, drafts, CAD files, and design materials shared during the commission process are confidential. Clients may not disclose, publish, or share these materials publicly without written permission from Pleiosien.


12. Turnaround Time
Estimated turnaround time will be provided at the time of booking.

Turnaround may vary depending on complexity, materials, and responsiveness to feedback.

Rush orders may be available for an additional fee.

13. Cancellations & Refunds
The 50% deposit is non-refundable, even if the client cancels the commission.

If the project is canceled after work has begun, the deposit will be retained to cover time, labour, and resources.

If the Designer is unable to complete the commission due to unforeseen circumstances, a partial or full refund may be issued at our discretion.

14. Intellectual Property, Copyright & Usage Rights
Ownership of Creative Work:
Unless explicitly agreed otherwise in a signed written contract, all designs, concepts, sketches, drawings, digital files, jewellery designs, prototypes, and any creative materials produced by Pleiosien remain the exclusive intellectual property of Pleiosien.

This includes:
- Final commissioned designs
- Drafts, variations, and revisions
- 3D models and production files
- Renderings, illustrations, and digital artwork.
- Any derivative or future adaptations of the design.
Pleiosien retains full copyright ownership of all creative output.

Client Ideas & References
Clients may submit:
- Sketches
- Drawings
- Mood boards
- Photos
- Concept descriptions
- Reference images
These materials are treated solely as inspiration.

Even if a client provides sketches or concept drawings, the final design created by Pleiosien is considered original creative work, and copyright belongs entirely to Pleiosien.

The final commission design is created through Pleiosien's professional skill, artistic judgement, and technical expertise, including CAD modelling, structural understanding, and jewellery design knowledge.

This is legally accurate because:
- Copyright protects the creator of the final expression, not the client who provided the idea/references.
- A client's sketch represents an idea; your final design represents original artistic expression.
- Copyright does not transfer unless a written assignment is signed by both parties.
Therefore, client-provided idea/references does not grant the client any ownership or copyright over the final design.

Client Usage Rights
Upon completion, the client receives a limited, non-exclusive, non-transferable license to use the final design solely for the purpose agreed upon (e.g., personal use, gifting, or display).

This license does not permit:

Manufacturing
- Commercial use
- Distribution
- Resale
- Modification
- Reverse engineering
- Trademark or branding use
- Uploading the design for production elsewhere
No intellectual property rights are transferred unless explicitly negotiated.

Designer Rights
Pleiosien retains unrestricted rights to:
- Reproduce
- Modify
- Adapt
- Manufacture
- Market
- Display
- Publish
- Sell
- Licence
- Create derivative works
This includes using the commissioned design in future collections, marketing, or product lines, unless an exclusivity agreement has been purchased.

Exclusivitiy, Copyright Transfer & Commercial Rights
If a client requires:
- Exclusive ownership
- Copyright assignment
- Commercial usage rights
- Manufacturing rights
- Trademark usage
- Full intellectual property transfer
These rights must be negotiated seperately, documented in a written agreement, and will incur significant additional fees based on scope of intended use.

Without such an agreement, Pleiosien retains full copyright and all associated intellectual property rights.


‎15. International/Domestic Shipping & Delivery
Pleiosien ships worldwide.
Standard shipping:
- Standard domestic and international shipping rates apply.
- Shipping costs are calculated at checkout based on your location.
- Tracking is provided for all international orders.

Express & Special Delivery
If you require:
- Express international shipping
- Courier services such as Uber, Didi, or same-day delivery
- Special handling or packaging
Additional fees will apply and will be added to your final invoice. You will be notified of any extra charges before your order is processed.

Customs & Import Duties
International clients are responsible for:
- Customs fees
- Import taxes
- VAT
- Duties
- Any delays caused by customs inspections
Pleiosien is not liable for parcles held, delayed, or rejected by customs authorities.


16. Additional Policies
Further‎ terms, protections, and conditions are detailed in the official Pleiosien Commission Contract, which must be signed before any work begins. You will receive access to this contract when you contact Pleiosien directly to request a commission.


17. No AI‑Generated Design

All Pleiosien designs, sketches, CAD models, concepts, and final artworks are created entirely by hand using professional design skills, technical knowledge, and jewellery‑making expertise. Pleiosien does not use AI image generation, AI design tools, or automated creative systems to produce commissioned work or product designs.

Every piece is developed through original human artistry, ensuring authenticity, craftsmanship, and creative integrity.

18. Agreement to Terms
By commissioning a design from Pleiosien, you acknowledge and agree to all the terms outline in this policy.
